Preparing for Your Appeals Hearing

If you are found to be ineligible, you will receive a Finding or Determination telling you that your claim has been denied. You have the right to appeal.

File an Appeal

Write a letter or complete the Request for Reconsideration of Claims Adjudicator's Determination  form within 30 days of the date the determination was mailed to you, outlining why you disagree with the Finding or Determination.
  • Mail, fax or deliver this to your local IDES office. The address and fax number appears on the Finding or Determination. If the reconsideration is denied, an appeal is automatically sent to the Appeals Division. You will receive a Notice of Hearing telling you the date and time of your hearing.
  • After the hearing, you will receive a Decision. If you miss your hearing, you can request to reopen the hearing within 10 days by showing good cause for missing the initial hearing.
  • If you are the claimant and you lose, you must repay any benefits you received. Overpaid benefits may be deducted from future benefits for which you become eligible or may be recovered by other means, including a civil lawsuit.

Mail or fax any documents or exhibits to the opposing party and the IDES Appeals Division at least 24-hours prior to the beginning of the hearing. Please mail these documents to the Chicago or Springfield IDES office address links below or fax to the number printed on your Notice of Hearing.

Additional Information
  • On the day of the hearing, an IDES Referee will call you and the other party so both sides can give their testimony. This hearing will be recorded.

Appeal to the Board of Review Help and Resources

File an Appeal

If you disagree with the Decision, you can appeal to the Board of Review:
  • The appeal must be in writing or you may use form APL124F: Notice of Appeal/Board of Review 
  • You must appeal within 30 calendar days of the date the Decision was mailed to you, state why you are appealing and include the docket number of the Referee's Decision.

  •  Appealing to the Board of Review .
  • The Board of Review will review all documents and testimony in the record and make a Decision, usually without another interview or hearing.
  • If you are dissatisfied with the Board of Review's Decision, you can appeal the Decision to the County Circuit Court within 35 calendar days.
